These terms and conditions apply to the use of this website and the purchase and delivery of products. Please read the following Terms and Conditions carefully before purchasing, these conditions contain important information and may change from time to time.

In these Terms and Conditions We, Our or Us means Empress Rug Warehouse and You or Your means the person who accepts these Terms and Conditions.

By using the empressrugs.com.au website or purchasing, You agree to these Terms and Conditions and this constitutes a legally binding Agreement between Us and You for the supply of Products.

The Agreement and purchase form an agreement between Us and You for the supply of Products. The Agreement cannot be varied unless We agree to vary it in writing or by email. We do not accept orders from minors, you must be 18 years old or more.

We strive to keep a clean website however, if you experience virus or such due to Your use of Our website we take no responsibility for this occurrence, please maintain Your own adequate protection.

Prices displayed on the website are subject to change without notice. All prices listed on the Website exclude delivery costs, these costs will be seen once in the check out section and You may see the delivery cost before purchasing the product/s. We aim to deliver through the most cost efficient method where delivery results in safe delivery of the goods. Note, You may collect the goods and pay no delivery. Customers please note all our products are warehoused in our shops and all rugs are available for purchase here, in the case that a product has been sold and then subsequently purchased on our website we offer our apologies and we will offer exchange or a full refund.

Product descriptions and conditions will be as close to actual product as possible and any errors made by us will entitle you to a full refund provided the rug is in the condition it was received in, which should be the condition that it left Our warehouse in.

Colour will vary and our photos and colour descriptions are indications only, many factors will affect the way a colour displays and colours will look different in different lights, on different monitors, this must be born in mind when purchasing and no liability will fall to Us for colours not meeting Your expectations, exchange of goods due to this are accepted but we have no obligation to refund.

Sizes will be as close as possible to the practical size, in that, if a product is not symmetrical we will give the measurement that best describes the space that it will fit.

All weights and dimensions of products described in the website are approximate.

We will primarily communicate with Customers via email, please ensure the correct contact details are entered.

We reserve the right to decline to do business with You at any time and We will decline on the grounds of fraud or suspected fraud.

In the need to cancel a sale for any reason a full refund may be offered.

We do not accept responsibility for any delay or loss of purchase due to internet problems, however we are always willing to help. We shall not be responsible for delay caused events or circumstances beyond Our reasonable control and we are entitled to extra time to reasonably complete delivery.

Incorrect or incomplete delivery addresses may result in extra delivery charges, You will be contacted regarding this. Where You have provided an incorrect or incomplete delivery address for Your Order, We may charge a re-delivery fee for each subsequent delivery attempt. We will not deliver products to PO Boxes.

Payment for purchases will be processed immediately upon confirmation of your order.

Delivery will be made as soon as practical and We endeavour to have goods leave Our warehouse within 3 working days, We do not guarantee this delivery departure as We rely on independent delivery services however we strive to meet this deadline. If You need your goods by a certain date contact the Warehouse directly by telephone 03 9388 0099 and We shall make an a delivery arrangement with You.

Where a Customer gives written authority for Products to be delivered without a signature, any and all included insurance cover will be voided.

We are not responsible for most of the delivery times of products and cannot ensure any delivery times, it is in Our interest that You receive the product so we are available to discuss delivery problems and ask You to call 03 9388 0099 or email enquiries@www.empressrugs.com.au.

Please note delivery to remote or rural locations is fine though bear in mind extra cost and delivery time.

Warranty. We may either repair, replace with same or similar or refund faulty or damaged goods if it is agreed by Us to be faulty. If we are unable to repair or replace the product, the customer will be provided with credit to spend within the next 12 months after that time We can provide a refund to the value of 80% of the original purchase price. Goods are considered to be returned once they are in our warehouse and signed for by one of Our staff and it is Your responsibility to ensure this happens. We will pay only agreed return delivery fees and we will not charge for new delivery charges if the goods were faulty.

Nothing in these Terms and Conditions excludes, restricts or modifies the consumer guarantees provided for by statute including under the Australian Consumer Law.

When returning goods we take no responsibility for a product lost in transit.

Privacy. We may keep your contact details in order to contact from time to time with special offers or information. We will not sell or give your details to anyone or any other business. We will not contact you often and you may request to be taken off our contact list at any time.
